Legal Requirements

As required under Australian law:

• A Notice of Intended Marriage (NOIM) must be lodged at least one month prior to your wedding date (and up to 18 months in advance)

• Valid identification must be provided and sighted

• If applicable, evidence of divorce or death of a former spouse is required.

• Signing the Notice of Intended Marriage.

  The NOIM must be witnessed and signed by your celebrant or in the presence of an authorised witness - a justice of the peace, barrister or solicitor, a medical practitioner, or a member of the Australian Federal Police or the police force in your State or Territory.

Required Identification

You’ll need to provide one of the following:

• An Australian or overseas passport (preferred, as it confirms photo, date and place of birth), or your original birth certificate (Australian or translated foreign) plus a government-issued photo ID such as a driver’s licence, learner’s permit or WA Photo Card.

• Proof of Marriage Termination (if applicable).
  If you’ve been previously married, you’ll need to provide a divorce certificate or decree absolute.
  A death certificate of your former spouse
